Purchaser Responsibility Agreement

Research-Use-Only Acknowledgment
All products sold by DSLabs (“Company,” “we,” “our”) are supplied strictly for in vitro laboratory research and analytical reference purposes. They are not drugs, dietary supplements, cosmetics, food additives, or medical devices. They are not intended for human or veterinary use, ingestion, injection, inhalation, topical application, or any form of administration to living organisms. The Purchaser affirms understanding of this limitation prior to placing any order.
Qualified Researcher Attestation
The Purchaser represents and warrants that they are a qualified researcher, scientist, academic, or licensed professional operating in an appropriate laboratory environment, and that they are at least 21 years of age. The Purchaser agrees to handle, store, and dispose of all materials in accordance with applicable laboratory safety standards, including but not limited to OSHA, NIH, and institutional biosafety guidelines.
Assumption of Risk
The Purchaser knowingly and voluntarily assumes all risks associated with the receipt, possession, handling, storage, transfer, and use of the products. The Purchaser acknowledges that the products may pose unknown health, environmental, and chemical hazards, and accepts full and exclusive responsibility for any and all consequences arising from their use or misuse.
Indemnification & Hold Harmless
The Purchaser agrees to indemnify, defend, and hold harmless DSLabs, its officers, directors, employees, agents, affiliates, suppliers, and contractors from and against any and all claims, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the Purchaser’s use or misuse of any product; (b) any violation of these terms or applicable law; or (c) any injury, illness, or death of any person or animal caused by the products.
No Resale for Human Consumption
The Purchaser shall not resell, repackage, redistribute, or transfer any product for human or veterinary use, nor shall they market or label any product in a manner suggesting suitability for such use. Any violation constitutes a material breach of this Agreement and immediate grounds for account termination and legal action.
Compliance with Law
The Purchaser agrees to comply with all applicable federal, state, provincial, and local laws, regulations, and rules, including those promulgated by the FDA, DEA, USDA, EPA, and any equivalent foreign authority. It is the sole responsibility of the Purchaser to determine the legality of receiving, possessing, and using any product within their jurisdiction.
Limitation of Liability
To the maximum extent permitted by law, DSLabs’s total aggregate liability arising from or related to any product shall not exceed the amount paid by the Purchaser for the specific product giving rise to the claim. In no event shall DSLabs be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
Acknowledgment
By checking the responsibility agreement box at checkout, the Purchaser certifies that they have read, understood, and agreed to be bound by every provision of this Agreement and the Terms & Conditions.
